Breath Tests in Denver DUI Cases

Handling DUI Charges from Failed Breath Tests

It is common knowledge that when you are initially pulled over in suspicion of drunk driving the arresting officer will have to officially establish your blood alcohol concentration (BAC) as above the legal limit of .08. One of the most common ways that an officer will do this is administering something like a field sobriety test, or a blood or breath test. During a breath test, you will be required to blow into a machine known as a breathalyzer, which will test the alcohol in the breath during your exhalation.

Many people assume that if you failed a test such as this that you have absolutely no hope for successfully combating the charges. There are many factors that can come into play during such a time that could have resulted in a faulty reading. An experienced DUI lawyer will look into every angle and aspect of your case. Questioning such things as the condition of your mouth during the administration of the test (if there was an abscess or something of the sort, it could affect the final reading). If the machine was not properly calibrated, if there was an interference, if more than two hours passed before the test was administered, if the officer was not properly trained on how to handle the machine or if they were not properly prepared to oversee the test, then the test can be seen as faulty and cannot be used as evidence against you.
